Amos Warren Proctor House
The house at 367 Boston Road stands on a narrow acre on the west side of the old road from Billerica to Lowell, a short walk north of the meetinghouse, about six rods wide on the road and twenty-six rods deep. Its deeds run back to the homestead of Oliver Whiting, who died in 1757 owning about sixty acres bounded east by the highway, north by William Baldwin and west by the Concord River. In 1758 his children sold "a certain Parcel of Land lying in Billerica aforesaid near the Meeting House containing Eight Acres and Ten Poles" to Oliver Abbot, a trader, and in 1795 Abbot sold the north end of it, three acres and seventeen poles on the country road between his own land and the heirs of William Baldwin, to Jonathan Patten Hall, a Boston apothecary.
Hall sold the three acres in 1796 for $330 to James Sumner Jr., a mariner of Beverly. In 1798 Sumner sold the south forty-three feet to the shoemaker Samuel Foster, who built his house there, and in 1799 he mortgaged the rest to Samuel Sumner of Boston, "reserving" the strip "which I sold to Saml. Foster the present year." The land then passed within the Sumner family without a recorded deed; in March 1824 James Sumner of Boston, Daniel Sumner of Wilmington and Betsy Carlton released it to Thomas Sumner of Billerica, and a month later Thomas sold "about three acres," bounded north by Joshua Bennett and west by the heirs of Dr. William Bowers, to Samuel Foster for $238.
In November 1841 Samuel Foster sold the north acre, still bare land, to Edward Mansfield, a yeoman, for $150. Mansfield built the present house, a plain house in the Greek Revival manner of the 1840s, but he died before March 1846. His father, Daniel Mansfield of Lynnfield, released his son's estate to the widow, Mary Mansfield, on condition that if she died within ten years what remained would be "divided equally between the two families." Mary died that same year, and in November 1846 Daniel sold his claim to Samuel Foster for $900. In 1850 Foster gave "the Mansfield Place ... with the buildings thereon" to his son Joseph Foster, whose inventory in 1859 valued it as his homestead, "About One acre of land, with the buildings thereon," at $1,550.
Joseph Foster left a widow, Lydia Ann, and three young children, Damon, Whitney and Annie M. Foster. Lydia remarried Daniel S. Giles, and while four lawsuits between her and the children over her dower were pending the children's guardian sold their land at auction in 1869 to George M. Brooks of Concord, who held it in trust for her. In May 1870 Brooks sold the house for $2,350 to Caroline J. Parker, the widow of Stephen Parker, and Lydia A. Giles released her dower; the 1875 map marks it "heirs of S. Parker." After Caroline Parker's death her administrators, Franklin Jaquith Jr. and Morton Simonds, sold it at auction on April 15, 1875 to Benjamin M. Butler of Medford for $2,225, and in October Butler sold it to John A. Merriam for $2,300.
Merriam's will was proved in April 1882, and on July 8 of that year his executor, Samuel Hoar of Concord, sold the house for $1,800 to Amos Warren Proctor, who gave back a $1,000 mortgage, paid off in 1888. Proctor had come to Billerica about 1865 to join Jonathan Hill's machine business in South Billerica, which made leather-splitting machinery under the Samuel Parker patent and continued as Hill and Proctor; after some years in a house near the shop he moved to the centre and lived here until his death in 1916. In December 1918 his heirs, Martha P. White of Worcester, A. Warren Stearns of Billerica and Richard W. Proctor of Cincinnati, sold it to Hugh Cochrane of Lowell, a chemist with Talbot Brothers.
Hugh Cochrane and his wife Della Adelaide put the house in both their names in 1941, and after their deaths their sons John and William D. Cochrane passed it in 1951 to John and his wife Emily H. Cochrane. In 1972 the Town of Billerica took a strip of 3,000 square feet along the north line of the back land for additions to Billerica Memorial High School and the Howe Junior High School, paying $500. After John Cochrane's death the house was sold in 1980 and changed hands privately in 1989 and 1998. In 2021 the lot was divided: the house kept "Lot A" of about 26,000 square feet, and the back land, "Parcel B" of 16,931 square feet, was sold to the Town for $95,000 to join the Town land to the north.
The 1973 survey dated the house about 1870 by comparing the 1853 and 1875 maps, and the assessor lists it as a two-family house built about 1900. The deeds show the acre bare in 1841 and "with the buildings thereon" in 1850, so the house was built by Edward Mansfield between 1841 and 1846.

Oliver Whiting died intestate in 1757. His son Jonathan Whiting was admitted administrator August 1, 1757 (bond with William Stickney and David Osgood). The inventory taken July 29, 1757 by Capt. Enoch Kidder, Joshua Abbot Jr. and David Osgood lists "the Homstead containing about sixty acres bounded as followeth Esterly by the hyway North by land of William Baldwin West by Concord River on the South by land of Enoch Kidder and partly on the hyway," a 21-acre lot west of the Concord River, and two acres on Whortleberry Hill. This is the old Danforth homestead bought in 1714; its east end, on the country road, became the Locke house lot.

For 108 pounds, "eight acres and ten poles" near the meeting house, bounded east by the highway 50 1/2 poles, north by William Baldwin 27 poles, west by "the Land which belonged to our Father" by a ditch, wall and stakes 52 poles, and south by the highway 25 1/2 poles. This is the east end of the Whiting (formerly Danforth) homestead, on the country road with the road to Carlisle on the south; the 24 acres sold to Benjamin Lewis in 1760 are bounded "easterly by Oliver Abbott." Joseph Foster died intestate early in 1859; his widow Lydia Ann Foster was appointed administratrix at Lowell on April 5, 1859, with Dudley Foster and Stephen Parker as sureties on a $5,000 bond. The inventory of April 2, 1859 (Lyman Haynes, Stephen Parker, Francis D. Foster) lists "About One acre of land, with the buildings thereon ... known as the Homestead" at $1,550, "One acre adjoining the Homestead" at $200, and about twenty acres of woodland at $275. Under a license of the Probate Court of June 8, 1869, the guardian sold at public auction for $2,085 all the minors' interest in three lots: the Joseph Foster house lot of about an acre "with the buildings thereon" on "the road leading from Billerica to Lowell"; "another lot of land containing about one acre," bounded north by the first lot, west by the heirs of William Bowers, south by Dudley Foster and east by the road (this lot), which came "by Dudley Foster by deed dated April 3, 1858" (Book 14, Page 40); and a woodlot of about 21 acres. Order of the Board of Selectmen dated December 18, 1972, recorded January 16, 1973, under the vote of the annual town meeting of March 11, 1972 (Article 76): "The Board of Selectmen hereby take in fee on behalf of the Town of Billerica by the power of eminent domain for purposes of school building additions and renovations to Memorial High School and renovations to the Howe Junior High School, two certain parcels of land." Parcel 2, owned by Major Contracting Corp., is bounded "NORTHWESTERLY by land of Forest W. Todd and Etta Todd, 1870 feet more or less, WESTERLY by the Concord River by various courses, 1150 feet more or less, SOUTHEASTERLY by land of Jacob M. Siegel and Herbert Siegel, 1835 feet more or less, EASTERLY by land of the Boston and Maine Corporation now or formerly, 1020 feet more or less," containing "43 acres, more or less and being parcel A" on the plan of Albert A. Miller and Wilbur C. Nylander of November 20, 1972 (Plan Book 116, Plan 25); damages $10,000. Parcel 1, 3,000 square feet of John and Emily Cochrane beside the Howe Junior High School, damages $500. For $95,000, "Parcel B" on a plan of land for 367 Boston Road by C & G Survey Company dated December 10, 2020 (Plan Book 248, Plan 103), 16,931 square feet of the back land, to be combined with the Town land to the north; title from the 1998 deed (Book 9565, Page 141). Private sales after the Cochranes, summarized: in January 1980 an heir of John Cochrane (estate probate 513854) sold the house for $75,000 to the 367 Boston Road Nominee Trust (Book 2403, Page 271), excepting the 1972 taking; private sales followed in 1989 ($212,500, Book 4840, Page 173), 1998 ($182,000, Book 9565, Page 141) and, for the house on Lot A of 25,987 square feet, in May 2021 ($760,000, Book 35699, Page 251).
